DMCA Policy – Maui Sports Unlimited LLC
Maui Sports Unlimited LLC (“Maui Sports Unlimited,” “we,” “our,” or “us”) respects the intellectual property rights of others and expects visitors, partners, and users of this site to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how we handle copyright infringement claims relating to content hosted on or served through mauisportsunlimited.com.
1. Designated Agent for DMCA Notices
If you believe that material available on this website infringes your copyright, you may submit a written DMCA notice to our designated agent:
DMCA Agent – Maui Sports Unlimited LLC
Email: info@mauisportsunlimited.com
Subject line: DMCA Notice – mauisportsunlimited.com
We prefer to receive DMCA notices by email for faster handling.
2. What a Valid DMCA Notice Must Include
To be effective under the DMCA, your notice must include all of the following information:
- Identification of the copyrighted work that you claim has been infringed, or a representative list if multiple works on a single site are covered by the notice.
- Identification of the material that you claim is infringing (or the subject of infringing activity) and that you request be removed or access to which be disabled, including the specific URL(s) on mauisportsunlimited.com.
- Information reasonably sufficient to allow us to contact you, such as your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your physical or electronic signature (typing your full legal name at the end of the notice is acceptable for electronic submissions).
3. What Happens After We Receive a DMCA Notice
Upon receiving a valid DMCA notice, we will:
- Review the claim and the identified content
- Remove or disable access to the allegedly infringing material where appropriate
- Make a good-faith effort to notify the user, contributor, or content owner whose material was removed or disabled
In some cases, especially for misunderstandings or borderline fair-use situations, we may reach out for clarification before taking action.
4. Counter-Notification (If Your Content Was Removed)
If your content was removed or disabled as a result of a DMCA notice, and you believe this removal was mistaken or that you have the legal right to use the material, you may submit a counter-notification. Your counter-notification must include:
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled (URL).
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in your district of residence (or, if outside the United States, that you consent to jurisdiction in the federal courts located in Hawaii, USA), and that you will accept service of process from the person who provided the original DMCA notice or their agent.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your physical or electronic signature (typing your full legal name is acceptable for electronic submissions).
Counter-notifications should be sent to the same DMCA Agent listed above.
5. Repeat Infringers
Where applicable, and at our sole discretion, we may limit or terminate access to this site for users who are found to be repeat infringers of others’ copyrights.
